1. Introduction
The present site is accessible via the domain name www.subtile.ai and is operated in accordance with Belgian law by Younes Afkari, registered under enterprise number 1012.168.274 (“Company,” “we,” “our,” “us,” “Subtile”).The use of this site is governed by these general terms and conditions. By using the site, you acknowledge that you have read these terms and accept them without reservation. Your agreement with us includes these Terms, and our Privacy Policy. We cannot be held responsible in any way for any misuse of our site by users.
2. Accounts
When you create an account with us, you guarantee that you are above the age of 18 and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.You are responsible for maintaining the confidentiality of your account and password, including but not limited to restricting access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You cannot share your account with other users.
You may not use as a username the name of another person or entity that is not lawfully available for use or a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar, or obscene.
We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.
3. Purchases
If you wish to purchase any product or service made available through Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.You represent and warrant that: (i) you are 18 year old or more; (ii) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (iii) the information you supply to us is true, correct and complete.
We may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.
We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order, default of payment, or other reasons.
We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
4. Subscriptions
Some parts of Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it. You may cancel your Subscription renewal either through your profile page or by contacting our support team at [email protected].
A valid payment method, including credit card, is required to process the payment for your subscription. You shall provide accurate and complete billing information including full name, address, state, zip code, telephone number, and valid payment method information. By submitting such payment information, you automatically authorize us to charge all Subscription fees incurred through your account to any such payment instruments.
Should automatic billing fail to occur for any reason, We will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.
If you are eligible for a discount, please note that you cannot use more than 1 (one) discount per subscription.
Note that a subscription is dedicated for a single person and could not be shared. If we detect any suspicious events, we may cancel without refund your subscription.
5. Price Adjustments
We, in our sole discretion and at any time, may modify Subscription fees for our services. Any price adjustment will become effective at the end of the then-current Billing Cycle.We will provide you with reasonable prior notice of any change in Subscription fees, giving you an opportunity to terminate your Subscription before the change takes effect. The discount is provided to help customers secure the current price without being surprised by future increases.
Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.
6. Refunds
Due to the nature of digital products, all monthly and annual purchases are non-refundable.You can cancel your subscription at any time by going to your profile, opening the Billing tab, and pressing Manage Subscription.
Your cancellation will take effect at the end of the current payment period, but no refunds or exchanges will be provided once access is granted.
7. Communications
By creating an Account on our Service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing at [email address].7. Prohibited Uses
You may use the Service only for lawful purposes and in accordance with the Terms.You agree not to use the Service:
- (a) In any way that violates any applicable national or international law or regulation.
- (b) For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
- (c) To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
- (d) To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
- (e) In any way that infringes upon the rights of others or is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
- (f) To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service or which, as determined by us, may harm or offend the Company or users of the Service or expose them to liability.
Additionally, you agree not to:
- (a) Use the Service in any manner that could disable, overburden, damage, or impair the Service or interfere with any other party&pos;s use of the Service, including their ability to engage in real-time activities through the Service.

- (e) Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
- (f) Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
- (g) Attack the Service via a denial-of-service attack or a distributed denial-of-service attack.
- (h) Take any action that may damage or falsify the Company&pos;s rating.
- (i) Otherwise attempt to interfere with the proper working of the Service.

It is not warranted that Subtile will meet your requirements or that its operation will be uninterrupted or error free. All express and implied warranties or conditions not stated in this Agreement (including without limitation, loss of profits, loss or corruption of data, business interruption or loss of contracts), so far as such exclusion or disclaimer is permitted under the applicable law are excluded and expressly disclaimed. This Agreement does not affect your statutory rights.You should ALWAYS keep a copy of your original content may it be fonts, videos or any other digital asset.
9. Warranties and Limitation of Liability
We does not give any warranty, guarantee or other term as to the quality, fitness for purpose or otherwise of the software. We shall not be liable to you by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by our negligence or the negligence of its servants or agents or otherwise) which arise out of or in connection with the provision of any goods or services by us.We shall not be liable or deemed to be in breach of contract by reason of any delay in performing, or failure to perform, any of its obligations if the delay or failure was due to any cause beyond its reasonable control. Notwithstanding contrary clauses in this Agreement, in the event that we are deemed liable to you for breach of this Agreement, you agree that our liability is limited to the amount actually paid by you for your services or software, which amount calculated in reliance upon this clause. You hereby release us from any and all obligations, liabilities and claims in excess of this limitation.
Furthermore, we are not responsible for what the user does with the user-generated content.
